By accessing or using our website, mobile application, or any services provided through our platform (collectively, "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use our Services.

Please read these Terms carefully before using our Platform. These Terms constitute a legally binding agreement between you ("User", "you", "your") and Exam Win.

1. Definitions

"Platform" refers to the Exam Win website, mobile application, and all associated services.
"Services" refers to mock tests, practice exams, study materials, performance analytics, preparation tips, and all other features offered through the Platform.
"User" refers to any individual who accesses or uses the Platform, whether registered or unregistered.
"Content" refers to all text, questions, explanations, images, data, and other materials available on the Platform.
"Subscription" or "Package" refers to any paid plan that grants access to premium features or exam-specific content.

2. Eligibility

You must be at least 13 years of age to use this Platform. If you are under 18, you must have consent from a parent or legal guardian.
By registering, you represent and warrant that all information you provide is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is your sole responsibility.
We reserve the right to suspend or terminate accounts that violate these Terms or are found to be fraudulent.

3. Nature of Services

The Platform provides online mock tests, practice questions, performance analytics, preparation tips, and related educational content for competitive exam preparation. Our Services are designed to supplement your study efforts and are not a substitute for thorough self-study, coaching, or any official exam preparation program.

4. No Guarantee of Success

THIS IS A CRITICAL CLAUSE. PLEASE READ CAREFULLY.

Exam Win does NOT guarantee, promise, or assure that using our Platform will result in passing any competitive examination, securing any rank, or achieving any specific score.
Exam results depend on numerous factors beyond our control including, but not limited to, the individual's effort, aptitude, study habits, prior knowledge, exam-day performance, and the policies of the examining body.
Mock test scores on our Platform are indicative only and do not predict, represent, or guarantee actual exam performance or results.
The difficulty level, pattern, and content of our mock tests may differ from the actual examination. We make reasonable efforts to align our content with the latest syllabus and patterns, but no representation is made that our tests are identical to any official examination.
Past performance of any user on our Platform does not guarantee future results for any other user.
Any testimonials, success stories, or performance statistics shared on the Platform are individual experiences and should not be construed as a guarantee of similar outcomes.
Under no circumstances shall Exam Win be held liable for any user's failure to clear any examination, secure a job, or achieve any desired outcome.

5. Account Registration & Security

To access certain features, you must create an account with a valid email address, name, and password.
You agree to provide truthful and accurate information during registration.
You are solely responsible for all activity that occurs under your account.
You must notify us immediately at support@exam.win if you suspect any unauthorized use of your account.
One account per individual. Sharing, selling, or transferring accounts is strictly prohibited.
We reserve the right to disable or delete accounts at our sole discretion, with or without notice, for any violation of these Terms.

6. Subscriptions, Payments & Pricing

Certain features and exam-specific content require a paid Subscription (Package).
All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
Payments are processed through third-party payment gateways (e.g., Razorpay). We do not store your credit/debit card or banking details on our servers.
Subscriptions are activated immediately upon successful payment confirmation.
We reserve the right to change pricing at any time without prior notice. Price changes will not affect active subscriptions already purchased.
In case of payment failure, no subscription will be activated. If the amount is debited but the subscription is not activated, please contact us within 7 days with your transaction details.

7. Refund & Cancellation Policy

All purchases are final and non-refundable once the subscription is activated and access to the content is granted.
Since our Services provide immediate access to digital content (mock tests, questions, explanations), refunds are generally not applicable.
Refunds may be considered only in the following exceptional cases:
- Duplicate payment due to a technical error (verified by our team).
- Payment was charged but subscription was never activated due to a system error.
Refund requests must be submitted within 7 days of the transaction to support@exam.win with transaction ID and payment proof.
Approved refunds will be processed within 7-14 business days to the original payment method.
No refunds will be granted for reasons including, but not limited to: dissatisfaction with content quality, change of mind, exam postponement or cancellation by the conducting body, or inability to use the Platform due to personal reasons.
We reserve the sole right to determine eligibility for any refund.

8. Intellectual Property Rights

All content on the Platform — including questions, explanations, text, graphics, logos, icons, images, software, code, and design — is the intellectual property of Exam Win or its content licensors.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial educational purposes only.
You shall NOT:
- Copy, reproduce, distribute, publish, or transmit any content from the Platform.
- Screenshot, record, download, or scrape questions, answers, or explanations.
- Share, resell, or redistribute your subscription access to any third party.
- Use automated tools, bots, or scripts to access or extract content.
- Modify, reverse-engineer, decompile, or create derivative works from our Platform.
Violation of intellectual property rights will result in immediate account termination and may lead to legal action.

9. Prohibited Conduct

While using the Platform, you agree NOT to:

Use the Platform for any unlawful, fraudulent, or malicious purpose.
Impersonate any person or entity, or misrepresent your affiliation.
Attempt to gain unauthorized access to the Platform, other user accounts, or our servers.
Introduce viruses, malware, or any harmful code.
Interfere with or disrupt the Platform's functionality or infrastructure.
Use the Platform to collect personal information of other users.
Share exam questions or content from the Platform on social media, forums, Telegram groups, or any other medium.
Use multiple accounts to gain unfair advantages or exploit promotional offers.
Engage in any activity that violates applicable Indian laws or regulations.

10. Content Accuracy & Updates

We strive to provide accurate, up-to-date, and relevant content. However, we do not warrant that all content is free from errors, omissions, or inaccuracies.
Exam patterns, syllabi, eligibility criteria, and other exam-related information may change at any time as per the decisions of the respective examination conducting bodies. We are not liable for any outdated information on our Platform.
Users are advised to always verify exam-related information from the official website of the respective examination body.
We reserve the right to add, modify, or remove any content from the Platform at any time without prior notice.

11. Third-Party Links & Services

The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites.
Payment processing is handled by third-party gateways. Your use of such services is governed by their respective terms and policies.
We do not endorse or assume liability for any third-party content or services.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Exam Win and its directors, officers, employees, agents, and affiliates shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of or inability to use the Platform.
- Any errors, inaccuracies, or omissions in the content.
- Unauthorized access to or alteration of your data.
- Any interruption, suspension, or termination of the Services.
- Any failure to clear any examination or secure any position.
- Any loss of data, revenue, profits, or goodwill.
Our total aggregate liability for any claim shall not exceed the amount paid by you to us in the 12 months preceding the claim.
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Indemnification

You agree to indemnify, defend, and hold harmless Exam Win, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

Your use or misuse of the Platform.
Your violation of these Terms.
Your violation of any third-party rights.
Any content you submit or transmit through the Platform.

14. Service Availability & Modifications

We strive to maintain 99.9% uptime but do not guarantee uninterrupted or error-free operation of the Platform.
We may temporarily suspend the Platform for maintenance, upgrades, or unforeseen technical issues.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.
We shall not be liable for any loss arising from service unavailability or modifications.

15. Termination

We may terminate or suspend your account and access to the Platform at our sole discretion, without prior notice, for any reason including violation of these Terms.
Upon termination, your right to use the Platform ceases immediately. No refund will be issued for any remaining subscription period.
Provisions that by their nature should survive termination shall survive, including Sections 4, 8, 12, 13, and 17.

16. Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
Before initiating any legal proceedings, the parties agree to attempt to resolve the dispute through good-faith negotiations for a period of 30 days.

18. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on the Platform.
Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
It is your responsibility to review these Terms periodically for updates.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and Exam Win regarding the use of the Platform and supersede all prior agreements, representations, and understandings.
